Where Do I go to Court of a Shoplifting Charge in Freehold?
All shoplifting charges will be governed by NJSA 2C:20-11b in New Jersey. The degree of the shoplifting charge will dictate what court will have jurisdiction over the charges. If a Defendant is charged with shoplifting the Freehold Township and the value of the merchandise is less than $200 (disorderly persons offense) then their charges will be heard in the Freehold Municipal Court, which is located at 1 Municipal Plaza. Conversely, if a Defendant is charged with shoplifting more than $200 worth of merchandise (felony) then their case will be heard in the Monmouth County Superior Court, which is also located in Freehold at 71 Monument Street. With that being said, it is possible for an experienced Monmouth County criminal defense to seek to have the felony shoplifting charges remanded back to the Freehold Municipal Court and be treated as disorderly persons offenses.
