Why Do I have to go to Freehold for my Shoplifting Charge?

The governing statute in New Jersey for shoplifting is NJSA 2C:20-11b. This offense can either be a disorderly persons offense or a second, third or fourth degree felony offense. The dollar amount of the merchandise in question is what dictates what degree of shoplifting a Defendant is charged with. It will also help dictate where the Defendant has to appear to defend those charges. Anyone charged with shoplifting more than $200 worth of merchandise will be charged with a felony offense. All felony offense shoplifting charges must transferred to the Monmouth County Superior Courthouse for disposition. Conversely, anyone charged with shoplifting less than $200 will be charged with a disorderly persons offense (misdemeanor). All disorderly persons offense shoplifting charges will be litigated in the local municipal court in the municipality where the offense occurred.
