As touched upon above, a shoplifting offense is not something to take lightly. This is a very serious charge and one that tends to be prosecuted to the fullest extent of the law. Pursuant to NJSA 2C:20-11b, which is New Jersey’s shoplifting statute, shoplifting can either a felony or a disorderly persons offense (misdemeanor). What will determine whether a Defendant is charged with a felony or a misdemeanor will be the dollar amount of the merchandise in question. The degree of the offense will also dictate what court has jurisdiction over the shoplifting charges. All disorderly persons offense shoplifting charges must be litigated in the municipality where the incident occurred. So, for example if the Defendant is alleged to have stolen $198 worth of clothes from Marshall’s, their charges will be sent to the North Brunswick Municipal Court, which is located at 710 Hermann Road for disposition. Conversely, if the Defendant is alleged have stolen clothes from Marshall’s that were valued at more than $201 then there charges must be transferred to the Middlesex County Superior Court, which is located in New Brunswick for disposition. With that being said, it is possible to have the felony shoplifting charges remanded back to the North Brunswick Municipal Court disposition.
