Is Shoplifting a Felony or Misdemeanor in NJ?

Shoplifting can be either a felony or a disorderly persons offense, which is New Jersey’s version of a misdemeanor. What separates the different degrees is the dollar amount of the merchandise in question. A Defendant’s prior criminal history is totally irrelevant when determining what degree of shoplifting they will be charged with. However, the degree of the offense charged will dictate where the case is litigated. All disorderly persons offense shoplifting charges will be litigated in the local municipal court in the municipality where the offense occurred. So for example, if the Defendant is alleged to have stolen under $200 worth of merchandise from a store in Lawrenceville, New Jersey their case will be heard in the Lawrenceville Municipal Court. However, if the Defendant is alleged to have stolen more than $200 worth of merchandise from a store in Lawrenceville, New Jersey then their case will be transferred to the Mercer County Superior Court which is located in Trenton because it is a felony offense. With that being said, it is possible for the Mercer County Prosecutor’s Office to remand the charges back to the local municipal court.
