The governing statute in New Jersey for shoplifting is NJSA 2C:20-11B. In essence, the offense of shoplifting can be either a disorderly persons offense (misdemeanor) or a second, third or fourth degree felony offense. The degree of the shoplifting offense will be determined solely by the dollar amount of the merchandise in question. A Defendant’s prior criminal record or where the offense occurred is irrelevant when determining whether the charges will be a felony or misdemeanors. The degree of the shoplifting charge will also dictate where the charges are litigated at. For example, if a Defendant is charged with a felony offense shoplifting, regardless of whether it is a second, third or fourth degree, the charges will be heard in the Somerset County Superior Courthouse which is located in Somerville, New Jersey. Conversely, if the charges are disorderly persons offenses then they will be heard in the local municipal court in the municipality where the incident occurred. With that being said, it is possible to convince the Somerset County Prosecutor’s Office to remand the felony level shoplifting charges back to the local municipality.
